Terms and Conditions for Swwipe
Swwipe Financial Services Limited (“Swwipe” or “We”), a Private Limited Liability Company. Swwipe is a Central Bank of Nigeria licensed Payment Solution Service Provider.
You are required to read and understand these rules as they are a binding agreement between you and Swwipe. Customers who are under eighteen (18) years of age should review these terms and conditions with a parent or guardian.
By registering for to use Swwipe or any of the services provided on this website, you agree to comply with and to be bound by these Terms of Use, including the Privacy Policy and all rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use.
By agreeing to this Terms of Use, you acknowledge and agree that Swwipe can maintain a deposit equivalent to your electronic value in one of its pool accounts domiciled at any of the CBN licensed banks or where applicable a third-party provider of the service you are using through Swwipe.
Intellectual Property
Unless otherwise stated, Swwipe and/or its licensors own the intellectual property rights and materials on the website. All text, formatting (including without limitation the arrangement of materials on Swwipe’s website and the graphics, animation, tools, commercials, music, video, articles, sound, copy, trade names, logos and other materials and information on the website are subject to the intellectual property rights of Swwipe and its affiliates and their licensors and licensees (collectively the “Content”). We do not grant you any right, license, title or interest to any of our intellectual Property rights which you may or may not have access to. These Content may not be copied, reverse engineered, decompiled, disassembles, modified or reposted to other websites. Nothing on Swwipe’s site should be construed as granting by implication or otherwise, any license or right to use any Trademark displayed on Swwipe’s website without the written permission of Swwipe or such third party that may own the Trademark. We reserve the right to change, modify, add or delete portions of these Terms of Use, at any time without prior notice to you. It is your responsibility to check these Terms and Conditions periodically for changes. Your continued use of the website following the posting of changes will mean that you accept and agree to the changes.
You are responsible for your connection to the mobile phone networks, the Internet and all costs associated with these same connections.
We are not responsible for any loss arising from any failure, malfunction, or delay in any mobile phone networks, mobile phones, ATMs, the Internet or terminals or any of its supporting or shared networks, resulting from circumstances beyond our reasonable control.
We may allocate any money received from you or held on your behalf to settle any outstanding balance on your account.

With respect to all the Personal Information belonging to, and/or processed in connection with Swwipe or this website, such Personal Information at all times are in compliance with all Data Protections Laws in the territory, in all respect and in particular the Nigeria Data Protection Regulation 2019 and all applicable data protection regulation in force. Swwipe maintains a Privacy Policy which provides an overview of the Personal Information we collect about you or that you provide to us and how we store and use the information provided by you in line with applicable Data protection legislations. By using Swwipe, you consent to such processing and you commit to provide accurate information.
Indemnification
You hereby indemnify Swwipe and undertake to keep Swwipe, its staff and affiliates indemnified against any losses, damages, costs, liabilities and expenses (including without limitation reasonable legal fees and expenses) arising out of any breach by you of any provision of these Terms, or arising out of any claim that you have breached any provision of these Terms. You will indemnify and hold Swwipe harmless from and against any claim, suit or proceedings brought against Swwipe arising from or in connection with violations of Intellectual Property or other rights of third parties in relation to your use of the Services.
Governing Law and Dispute Resolution
You acknowledge and agree that these Terms and Conditions are governed by Nigerian law and any breach of these Terms and Conditions will be considered as having taken place in Nigeria.
Where Parties are unable to amicably resolve their dispute or claim arising out of or in relation to this Agreement, such dispute shall be referred for mediation to the Lagos Multi-Door Court House and shall be resolved under the Rules of the Lagos Multi-Door Court House. If the dispute is not resolved by mediation at the Lagos Multi-Door Court House within a period of fifteen (15) days from the date of submission, either Party may refer the dispute to arbitration in accordance with the Arbitration and Mediation Act 2023.
